Terms of Service

The Services are not directed to, or intended for use by, children under the age of 13. You must be at least 13 years old to use the Services. If you are between 13 and the age of majority in your jurisdiction, you may use the Services only with the involvement of a parent or legal guardian. By using the Services, you represent that you meet these requirements.

If you are using the Services on behalf of a veterinary practice or other organization, you represent that you have authority to bind that organization to these Terms.

The Site is a marketing website where you can learn about Animedic's forthcoming pet health application and veterinary practice platform, join a waitlist, request early access, and contact us. Features are described throughout the Site; descriptions are provided for general information and do not create contractual commitments as to product functionality. We may add, change, or remove features at any time.

The Services are not intended to provide veterinary, medical, diagnostic, or treatment advice. Nothing on the Site should be relied upon as a substitute for professional advice from a qualified veterinarian. If your pet has a medical emergency, contact a licensed veterinarian or emergency veterinary clinic immediately.

You are responsible for the accuracy of any information you submit, including email addresses, names, and practice information, and for maintaining the confidentiality of any credentials we may later issue. You must not impersonate another person or provide information that is false, misleading, or that infringes anyone's rights.

You agree not to:

• Use the Services to violate any law or regulation, or to infringe any third party's intellectual property, privacy, or other rights.
• Attempt to gain unauthorized access to the Services, other users' data, or any connected systems.
• Introduce malware, scrape the Site other than for legitimate, rate-respectful indexing, submit automated form submissions without permission, or otherwise interfere with normal operation.
• Reverse-engineer, decompile, or attempt to derive the source code of any part of the Services except to the extent such restriction is prohibited by law.
• Use the Services in a manner that could harm, disable, overburden, or impair them.

The Services, including all text, graphics, logos, software, and design, are owned by or licensed to Animedic and are protected by intellectual property laws. The "Animedic" name and logomark are trademarks of Animedic LLC. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works of the Services.

You retain any rights in the content you submit to us (such as messages via the contact form). By submitting content, you grant Animedic a worldwide, royalty-free, non-exclusive license to use that content solely to provide and improve the Services and to respond to you.

Placement on a waitlist does not guarantee access to any product or beta. We may select participants at our discretion, limit participation, or discontinue a waitlist at any time. Waitlist participation is non-transferable and has no cash value.

Some features referenced on the Site (for example, an "AI symptom check" in our forthcoming application) will make use of machine-learning models. Please read our AI Disclaimer for important limitations before relying on any AI-generated output.

The Services may interoperate with or link to third-party services. Your use of any third-party service is subject to the terms and privacy practices of that service, not these Terms. We are not responsible for the content, products, or practices of third parties.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. ANIMEDIC DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY INFORMATION OBTAINED THROUGH THE SERVICES WILL BE ACCURATE OR RELIABLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANIMEDIC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES.

ANIMEDIC'S AGGREGATE LIABILITY UNDER THESE TERMS FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00) OR, IF GREATER, THE AMOUNTS YOU PAID TO ANIMEDIC IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the limitations above; in those jurisdictions, the limitations apply only to the maximum extent permitted.

You agree to defend, indemnify, and hold harmless Animedic from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; or (c) your violation of any third-party right, including any intellectual property or privacy right.

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or if we retire any Service. You may stop using the Services at any time. Sections that by their nature should survive termination will survive.

These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-laws principles. Except where prohibited, any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Washington County, Utah, and you consent to personal jurisdiction and venue there.

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, by additional notice on the Site. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

• Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Animedic regarding the Services.
• Severability. If any provision is found unenforceable, the remaining provisions will remain in effect.
• No waiver. Failure to enforce any provision is not a waiver of that provision.
• Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
